1. Agreement to Terms
By signing up for The Office Foreman ("Service," "we," "us," or "our"), you agree to these Terms of Service. If you don't agree, please don't use our service.
2. Service Description
What we provide:
Text-based administrative support for contractors and tradespeople
Receipt organization and forwarding to your bookkeeper
Mileage tracking and log preparation
Invoice reminders and follow-ups
General administrative assistance via text message
Access to resource library and templates
Coordination with your bookkeeper (with your permission)
What we DON'T provide:
We are NOT bookkeepers, accountants, or CPAs
We do NOT prepare tax returns or provide tax advice
We do NOT provide legal advice
We do NOT offer financial planning or business consulting
We do NOT guarantee any specific financial outcomes
We do NOT provide emergency 24/7 support
3. Membership and Billing
Subscription:
Monthly membership: $99/month
Billed automatically on the same day each month (date determined by date of signup)
No long-term contracts required
Month-to-month commitment
Payment:
Payment processed through Squarespace
You authorize recurring monthly charges
Fees are non-refundable except as stated in Section 4
We reserve the right to change pricing with 30 days notice
Failed Payments:
If payment fails, we'll attempt to contact you
Service may be suspended after 3 days of non-payment
Account terminated after 10 days of non-payment
You're responsible for any payment recovery fees
4. Cancellation and Refunds
You can cancel anytime:
No cancellation fees
Email us at TheOfficeForeman@gmail.com or text CANCEL
Cancellation effective at end of current billing period
You'll retain access until the end of paid period
No refunds for partial months
Money-Back Guarantee (First Month Only):
If you're not satisfied in your first 30 days, we'll refund your first month
Request refund via email: TheOfficeForeman@gmail.com
After first month, no refunds for any reason
We may cancel your account if:
You violate these Terms
You abuse the service (harassment, spam, illegal activity)
Your payment repeatedly fails
You provide false information
5. Your Responsibilities
You agree to:
Provide accurate contact and billing information
Keep your phone number current and active
Send clear, readable receipt photos
Respond to our requests for clarification in a timely manner
Maintain your own backups of important documents
Pay your bookkeeper/CPA separately (we're not their substitute)
Use the service only for legitimate business purposes
Treat us with respect (no harassment or abuse)
You agree NOT to:
Share your membership access with others
Use the service for illegal purposes
Send us threatening, harassing, or abusive messages
Attempt to hold us liable for bookkeeping or tax errors
Misrepresent information to us or your bookkeeper
Spam our text line with excessive non-service messages
6. Text Messaging Terms
By using our service, you consent to:
Receive text messages at the number you provide
Messages from us during business hours (7am-7pm Mon-Fri, Central Time)
Occasional messages outside business hours if urgent
Message frequency varies based on your usage (typically 5-15 per week)
Text Message Opt-Out:
You can opt out anytime by replying STOP
Opting out ends your ability to use the service
If you opt out, your membership continues but service is unavailable
You must cancel membership separately to stop billing
Message & Data Rates:
Standard message and data rates apply from your carrier
We're not responsible for carrier charges
We recommend an unlimited texting plan
7. Service Availability
Our service hours:
Monday - Friday: 7am - 7pm Central Time
Saturday & Sunday: Closed (emergency texts answered Monday)
Holidays: Reduced hours (notified in advance)
Response times:
Standard messages: Within 4 hours during business hours
Complex requests: Within 24-48 hours
After-hours messages: Responded to next business day
We don't guarantee:
Instant responses
24/7 availability
Uninterrupted service (technical issues may occur)
That your bookkeeper will accept our format
8. Limitation of Liability
IMPORTANT - PLEASE READ:
We are an administrative support service, not financial professionals.
We are NOT liable for:
Errors in bookkeeping or tax preparation (done by your bookkeeper/CPA)
Lost receipts or documents (you should keep your own copies)
Missed tax deadlines or penalties
IRS audits or tax issues
Financial losses of any kind
Business decisions you make based on our reminders
Mistakes in mileage calculations (estimates only)
Your bookkeeper's errors or omissions
Technical failures (phone service, internet outages)
Any damages exceeding the amount you paid us in the last 3 months
You acknowledge that:
We organize information; we don't verify its accuracy
Your bookkeeper/CPA is responsible for actual bookkeeping and taxes
You're ultimately responsible for your business finances and taxes
We provide administrative support, not professional financial advice
You should review all organized information before it goes to your bookkeeper
Maximum Liability: If we're found liable for anything, our maximum liability is limited to the amount you paid us in the 3 months before the claim.
9. Intellectual Property
Our property:
Templates, checklists, and resources we provide remain our property
You can use them for your business while you're a member
You can't resell, redistribute, or claim them as your own
Our service name, logo, and branding are our trademarks
Your property:
Your business information, receipts, and documents remain yours
We have a limited license to organize and share them per your direction
You can request copies of everything at any time
We'll delete your information after the retention period (see Privacy Policy)
10. Third-Party Services
We use these third-party services:
Squarespace: For website and payment processing
OpenPhone/Quo: For business text messaging
Google Drive (or similar): For document storage and organization
You understand that:
These services have their own terms and privacy policies
We're not responsible for their failures or data breaches
Service interruptions may affect our ability to serve you
We may change service providers with notice
11. Disclaimer of Warranties
Our service is provided "AS IS" and "AS AVAILABLE."
We make no warranties:
That the service will be uninterrupted or error-free
That your bookkeeper will accept our format
That you'll save money or improve your business
That we'll catch every receipt or reminder
About the accuracy of mileage calculations (estimates only)
That texts will always be delivered (carrier issues can occur)
12. Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:
Your violation of these Terms
Your violation of any law or regulation
Your bookkeeper or CPA's errors
Your business activities
Information you provide to us
Disputes with your bookkeeper, CPA, or customers
13. Dispute Resolution
If there's a problem:

We'll work with you in good faith to resolve it
Most issues can be solved with a conversation
Arbitration:
If we can't resolve a dispute informally, it will be resolved through binding arbitration
Arbitration will be in Baldwin County, Alabama
Alabama law governs these Terms
No class actions or jury trials
Small Claims Court:
Either party may bring a claim in small claims court instead of arbitration
Claims under $5,000 may be filed in Baldwin County small claims court
14. General Terms
Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and us.
Severability: If any provision is found unenforceable, the rest remains in effect.
Waiver: Our failure to enforce any right doesn't waive that right.
Assignment: You can't transfer your membership. We may transfer our rights with notice.
Force Majeure: We're not liable for delays caused by circumstances beyond our control (natural disasters, internet outages, pandemics, etc.).
Changes to Terms: We may update these Terms with 30 days notice via email or text. Continued use after changes means you accept the new Terms.
Survival: Sections about liability, disputes, and intellectual property survive after termination.
15. State-Specific Terms
Alabama-Specific:
These Terms are governed by Alabama law
Disputes resolved in Baldwin County, Alabama
We comply with Alabama business licensing requirements
Contractor Services:
We don't provide contractor licensing advice
We don't replace required contractor insurance
Compliance with Alabama contractor regulations is your responsibility

You agree to receive text messages as described
You understand we're not bookkeepers, CPAs, or financial advisors
You're responsible for your own business finances and taxes
You're at least 18 years old and legally able to enter this agreement
The information you provide is accurate
If you don't agree with these Terms, please don't use our service.
